RETURN & CANCELLATION POLICY

READ THIS POLICY CAREFULLY BEFORE ENROLLING OR USING ANY SERVICES

By enrolling in or using the Home Improvement Buying Club (“Club”) services, products, or content (collectively, “Services”), you expressly acknowledge and agree to the following terms. If you do not agree, do not enroll, purchase, or use the Services.

1. Membership Cancellations

  • 1.1 30-Day Free Cancellation

    Members may cancel within 30 days of initial enrollment at no charge, provided no orders, transactions, or product redemptions have occurred. Once any transaction has been processed, cancellation will still be allowed only subject to pro-rated adjustments and Club discretion.

  • 1.2 Written Notice Required

    All cancellations must be submitted in writing via the Club’s designated email or contact form. Include full legal name, membership ID, and contact information. Cancellations are not effective until acknowledged in writing by the Club.

  • 1.3 Non-Refundable Fees

    All membership fees, administrative fees, and processing costs are non-refundable after 30 days or after any transaction is completed. Any exceptions are solely at the discretion of Home Improvement Buying Club.

2. Product Returns & Refunds

  • 2.1 Return Eligibility

    Products may only be returned if they are defective, damaged, or materially not as described. To be eligible:

    Return requests must be made within 15 calendar days of receipt;

    Items must be unused, in original packaging, and include proof of purchase;

    The Club reserves the right to reject any return that fails to meet these conditions.

  • 2.2 Non-Returnable Items

    The following items are strictly non-returnable:

    Digital or downloadable products;

    Customized, personalized, or special-order items;

    Clearance, discounted, or promotional products;

    Any items purchased via third-party vendors.

  • 2.3 Refund Processing

    Approved refunds will be credited to the original payment method only, within 15 business days of approval. Shipping, handling, and associated costs are non-refundable.

3. Limitation of Liability

  • To the maximum extent permitted by law, Home Improvement Buying Club, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for:

    Any direct, indirect, incidental, consequential, punitive, or exemplary damages;

    Loss of profits, revenue, business opportunities, data, or goodwill;

    Damages arising from delays, errors, or omissions in Services, products, or information;

    Third-party actions, product defects, shipping delays, technical errors, or system failures;

    Any claims arising from unauthorized access or misuse of the Site or Services.

    This limitation applies even if the Club was advised of potential damages and regardless of legal theory.

4. Indemnification

  • You agree to indemnify, defend, and hold harmless Home Improvement Buying Club, its affiliates, officers, directors, employees, agents, licensors, and partners against any and all claims, liabilities, losses, damages, costs, or expenses, including reasonable attorney fees, arising from:

    Your use or misuse of the Club, Services, or products;

    Violation of this Return & Cancellation Policy or Terms of Use;

    Breach of applicable law or third-party rights;

    Any reliance on Club information, products, or services.

5. Arbitration & Class Action Waiver

  • Any dispute, claim, or controversy arising out of or relating to membership, cancellations, returns, refunds, or Services shall be resolved exclusively through binding arbitration under the American Arbitration Association (AAA) rules or another mutually agreed arbitration organization.

    By agreeing to this Policy, you waive your right to a trial by jury and the right to participate in any class action. Arbitration shall occur in the state where the membership was purchased, unless otherwise mutually agreed. Decisions of the arbitrator are final and binding, and may be enforced in any court of competent jurisdiction.

6. Governing Law & Jurisdiction

  • This Policy and any disputes arising from it shall be governed by the laws of the state in which the membership was purchased, without regard to conflict-of-law principles. Any legal action must be brought in the competent courts of that state.

7. Non-Liability for Third Parties

  • The Club is not responsible for third-party products, vendors, shipping services, or technical platforms. Any claims regarding third-party products or services must be directed to the third party.

8. Time Limits & Procedural Requirements

  • Return requests or membership cancellations must comply strictly with deadlines and submission requirements outlined herein.

    Requests received after the stated deadlines will be rejected.

    The Club reserves the right to verify, deny, or adjust any claim at its discretion.

9. Severability

  • If any provision of this Policy is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent allowed by law.

10. Policy Modifications

  • The Club reserves the right to amend, update, or modify this Policy at any time. The “Effective Date” at the top reflects the current version. Continued use of Services after updates constitutes acceptance of the revised Policy.
